Nurse Habila’s Death: SOKAPU Drags Umahi to Court, Demands Autopsy and N20bn Compensation

The Federal High Court in Kaduna will hear SOKAPU’s suit against David Umahi over nurse Mary Habila’s death, with an autopsy and N20bn sought.

The Southern Kaduna Peoples’ United Association (SOKAPU) has instituted legal proceedings against Minister of Works David Umahi at the Federal High Court in Kaduna over the death of nurse Mary Habila, who was serving as part of the minister’s medical team.

Habila reportedly died on June 27 at Umahi’s residence, prompting public concern and increasing demands for an independent investigation into the circumstances of her death.

In the suit, SOKAPU also listed Habila Tanko Wisdom, father of the deceased, the Attorney-General of Ebonyi State, and the Ebonyi State Commissioner of Police as respondents.

The association is seeking a court order directing that an autopsy be conducted to determine the cause of Habila’s death. It is also asking the court to award N20 billion in damages against the minister, alleging that there was a breach of duty of care while the deceased was in his custody.

The legal action comes after the Ebonyi State Police Command reaffirmed that an autopsy would be performed despite reported objections from some members of the deceased’s family.

Earlier, Umahi had formally requested the Ebonyi State Commissioner of Police to ensure that an autopsy was carried out as part of efforts to establish the circumstances surrounding the nurse’s death.

The suit is expected to raise key legal questions regarding accountability, duty of care and the determination of the cause of death through judicial and investigative procedures.

No date has yet been scheduled for the hearing of the case.
