Osun Govt Seeks Court Order to Probe Fadahunsi Over ‘Kill Accord’ Allegations

Osun Government asks the High Court to compel police to investigate Senator Francis Fadahunsi over alleged threats against Accord Party members ahead of Saturday’s election.

The Osun State Government has asked the High Court of Osun State to compel the police to investigate Senator Francis Adenigba Fadahunsi over alleged threats against members and supporters of the Accord Party ahead of the August 15 governorship election.

The case, HOS/M.157/26, was instituted on August 12, 2026, at the Osogbo Judicial Division, just three days before the scheduled poll.

The state Attorney-General and Commissioner for Justice, Oluwole Jimi-Bada, SAN, brought the application against the Inspector-General of Police and the Commissioner of Police, Osun State Command, seeking an Order of Mandamus. Fadahunsi, representing Osun East Senatorial District, was joined as the person affected or interested party.

The government said it filed the suit after a video emerged on social media, purportedly showing Fadahunsi speaking at a political gathering in front of the Owa Obokun’s Palace in Ilesha on August 11.

Court documents alleged that some of the senator’s remarks could amount to incitement or calls for violence against members of the Accord Party.

According to the government, a transcript and translation of the speech showed that Fadahunsi allegedly instructed his supporters to attack Accord members whenever they came across them and allegedly threatened their families.

The filings further alleged that he ordered supporters to eject Accord members from hotels where they were found and made disparaging comments about the party’s yellow caps.

The government also accused the senator of threatening that the governorship election would not hold if Accord members resisted the alleged actions of APC supporters.

The state is therefore asking the court to compel the police to investigate the video and establish whether the alleged statements amount to criminal offences under Nigerian law.

It is also seeking an order requiring the police to preserve the original video, authenticate it and carry out a forensic examination to determine whether it had been edited or manipulated.

The government wants additional measures put in place to safeguard Accord candidates, supporters and voters from intimidation and harassment before, during and after Saturday’s election.

It is also asking the court to ensure that registered voters and Accord supporters can freely access hotels and other locations during the electoral period.

Another relief sought is an order requiring the respondents to provide a compliance report within 48 hours of any directives issued by the court.

In the affidavit supporting the application, Nurudeen Kareem, Special Adviser to Governor Ademola Adeleke on Legal Matters, said members of the Accord Party had raised “reasonable and legitimate concerns regarding their safety and security before, during, and after the forthcoming election.”

The state argued that the Police Act 2020 and the 1999 Constitution impose a responsibility on the police to prevent crime and maintain public order.

It further argued that waiting for violence to occur before acting on an alleged public threat would defeat the preventive purpose of policing.

“The Applicant believes that waiting until actual violence, deaths, or injuries occur before investigating an alleged public instruction to kill political opponents would amount to a dereliction of duty,” the government said.

However, the Attorney-General stressed that the case was not intended to determine whether Fadahunsi was criminally guilty. Such a determination, the government noted, would have to be made through a proper criminal trial.

Rather, the state said it wants the court to compel the police to perform their statutory duties and take preventive steps where necessary.

As the August 15 election approaches, the government insisted that “time is of the absolute essence.” It warned that failure to investigate and respond to the alleged threats could result in “irreparable harm, loss of life, and widespread civil unrest.”
