“OpenAI Faces Key Testimony as Musk Lawsuit Moves Into Week Two”

The courtroom clash between billionaire Elon Musk and OpenAI has entered its second week, with co-founder Greg Brockman set to testify in the ongoing California trial.

Musk is seeking a court order to force OpenAI to revert to a non-profit foundation, challenging its current hybrid structure.

Brockman will take the stand at the Oakland courthouse on Monday, while CEO Sam Altman is expected to testify in the coming week.

The case is being closely watched due to its potential impact on OpenAI’s future, as the company—valued at over $850 billion—prepares for a possible IPO.

Microsoft CEO Satya Nadella could also appear as a witness, as his company faces allegations of backing OpenAI’s commercial transition.

Last week, Musk told the court he had donated $38 million to OpenAI between 2016 and 2020, portraying himself as a founding supporter who was later sidelined.

He maintained that his aim was to prevent dominance by companies like Google and to keep powerful AI technologies from being driven solely by profit motives.

OpenAI’s lawyers have countered by questioning Musk’s intentions, pointing to his own AI venture, xAI, which produces the Grok chatbot and has been integrated into SpaceX.

A ruling in Musk’s favour could disrupt OpenAI’s IPO plans and alter the competitive dynamics of the global AI industry, where firms such as Google, Anthropic, and Chinese tech companies are rapidly advancing.

Despite the sector generating billions in revenue annually, companies continue to face significant costs tied to talent, infrastructure, and energy-intensive data centres driving AI development.
