Abstract

Nollywood has become one of the world’s largest film industries and a major contributor to Nigeria’s economy and cultural identity. Despite its rapid growth, the industry continues to face challenges such as piracy, copyright infringement, and weak enforcement of intellectual property (IP) rights. This article examines the role of intellectual property law in promoting Nollywood’s growth by protecting creative works, encouraging investment, and fostering innovation. It also highlights the legal framework governing copyright protection in Nigeria, identifies key challenges, and recommends measures for strengthening intellectual property enforcement.

Introduction
 Nollywood has evolved into a significant pillar of Nigeria’s creative economy, generating   employment and projecting Nigerian culture globally. Since the release of Living in Bondage in 1992, the industry has experienced remarkable expansion through technological advancement and digital distribution. However, piracy and unauthorized exploitation of films continue to deprive creators and investors of legitimate income, thereby discouraging creativity and investment. Effective intellectual property protection is therefore essential to the industry’s sustainability and international competitiveness.

Intellectual Property and Copyright
Intellectual property refers to legally protected creations of the mind, including literary and artistic works, inventions, trademarks, and designs. For the film industry, copyright is the most relevant form of protection. It grants creators exclusive rights to reproduce, distribute, adapt, and communicate their works to the public. Under section 2 of the Copyright Act 2022, cinematograph films qualify for copyright protection in Nigeria. This legal protection enables filmmakers to control the commercial exploitation of their works and prevent unauthorized use.

Intellectual Property Law and Nollywood’s Growth
Intellectual property law plays a vital role in Nollywood’s development. First, it protects creative investment by ensuring that producers can recover the substantial costs associated with film production, marketing, and distribution. Secondly, copyright encourages creativity by rewarding originality and providing incentives for filmmakers to produce quality content.

Furthermore, copyright protection creates multiple revenue streams through cinema exhibitions, television broadcasting, streaming platforms, licensing, merchandising, and international distribution. A strong intellectual property regime also enhances investor confidence and promotes international partnerships, making Nollywood more attractive to foreign distributors and collaborators.

Legal Framework
The Copyright Act 2022 is the principal legislation governing copyright protection in Nigeria. It grants copyright owners exclusive rights over their works and provides both civil and criminal remedies against infringement, including injunctions, damages, seizure of infringing materials, and prosecution. Nigeria is also a party to key international agreements such as the Berne Convention, the WIPO Copyright Treaty, and the TRIPS Agreement, all of which establish minimum standards for copyright protection and facilitate international enforcement.

Challenges
Despite this legal framework, piracy remains the greatest threat to Nollywood’s growth. Illegal duplication and online distribution of films significantly reduce revenue for producers and investors. The rapid expansion of digital platforms has further complicated enforcement, as infringing content can be shared instantly across multiple online platforms. Additionally, weak institutional capacity, inadequate funding, delays in the judicial system, and limited public awareness continue to undermine effective copyright enforcement.

Recommendations
To strengthen intellectual property protection in Nollywood, the Nigerian Copyright Commission should be better equipped to enforce copyright laws effectively. Specialized intellectual property courts should also be established to ensure speedy resolution of infringement cases. Public awareness campaigns are necessary to discourage piracy and educate consumers about the economic consequences of copyright infringement. The adoption of advanced anti-piracy technologies and stronger collaboration between government agencies, industry stakeholders, and international partners will further enhance the protection of creative works.

Conclusion
Intellectual property law remains indispensable to Nollywood’s continued growth and sustainability. By protecting creative works, encouraging investment, and promoting innovation, copyright law provides the legal foundation for the industry’s success. Although piracy and digital infringement remain significant challenges, the Copyright Act 2022 offers a stronger legal framework for protecting creators’ rights. Effective enforcement of intellectual property rights will ensure that Nollywood continues to thrive as a globally competitive and economically valuable creative industry.
