Federal High Court Cancels NDC Registration Ordered Against INEC

The NDC has lost its official political party status after a court set aside an earlier judgment compelling INEC to register the party.

A Federal High Court sitting in Lokoja has overturned its previous judgment directing the Independent National Electoral Commission (INEC) to register the New Nigeria Democratic Congress (NDC) as a political party.

The ruling, delivered on June 26, 2026, effectively strips the NDC of its registration status and places the party back at the starting point of the registration process.

The court held that the earlier December 2025 judgment compelling INEC to recognise the party contained procedural and statutory defects.

As a result, the NDC is currently not recognised by the electoral commission and cannot sponsor candidates for elections unless it wins an appeal or completes the registration process afresh in line with the Electoral Act 2022.

The decision comes weeks after an Action Democratic Alliance (ADA) member filed a separate suit challenging the legality of the NDC’s registration.

The plaintiff argued that the party failed to meet constitutional and statutory registration requirements and was improperly granted recognition.

In another related development, an Abuja High Court had ordered the deregistration of the African Democratic Congress (ADC), Accord, Action Alliance (AA), All Progressives Party (APP), and Zenith Labour Party (ZLP).

The court based its ruling on the parties’ alleged failure to meet constitutional electoral performance requirements.

However, the Court of Appeal subsequently suspended the enforcement of the order after granting a stay of execution pending further hearing.

The court battles have added fresh uncertainty to Nigeria’s political landscape as preparations for the 2027 elections gather momentum.
