Rivers Lawmakers, Tread Carefully: Impeachment Without Merit Threatens Peace, Governance, And Democracy -By Isaac Asabor

Rivers State deserves political leaders who value democracy over ambition, peace over discord, and governance over vendetta. Lawmakers must act with prudence, restraint, and respect for constitutional processes. Anything less will imperil the state’s democratic foundations and threaten the very stability they are elected to safeguard.

As Rivers State lawmakers deliberate the impeachment of Governor Siminalayi Fubara, live on Channels Television as this piece is being written on the morning of Thursday, January 8, 2026, the stakes are far greater than ordinary political rivalry. Impeachment is not merely a legislative procedure; it is a constitutional mechanism meant to enforce accountability, safeguard democratic integrity, and protect public trust. When wielded for partisan advantage or personal gain, it risks consequences that reach well beyond the chambers of government. Lawmakers must pause and weigh the long-term impact of their actions, not just on themselves, but on the stability, peace, and prosperity of Rivers State.

Given the foregoing, it suffices to opine in this context that resorting to the constitutional is Imperative; impeachment is not a political weapon.  Under “Section 188 of the 1999 Constitution”, the process of impeaching a governor is deliberately rigorous. The law requires a multi-step procedure, including a proper investigation, the establishment of an impartial panel, and the guarantee of a fair hearing for the governor. These safeguards exist to prevent abuse of power and ensure that impeachment remains a mechanism for justice, not vendetta.

Unfortunately, history in Nigeria and across other democratic states has shown that politically motivated impeachments almost always fail judicial scrutiny. Courts have repeatedly nullified impeachments conducted without full adherence to constitutional procedures. Lawmakers in Rivers State must recognize that any attempt to sidestep due process, no matter how urgent or politically convenient, risks legal invalidation and public backlash.

Even “Section 188(10)”, which appears to limit judicial interference in impeachment proceedings, does not remove the courts’ authority to assess the legality of the process itself. When procedural steps are ignored or manipulated, the judiciary has consistently intervened to protect constitutional integrity. This is not merely a technicality, it is a safeguard that preserves democracy, prevents arbitrary removal of elected officials, and ensures that governance is not subject to political whims.

Moreover, governors enjoy immunity from civil or criminal proceedings while in office under “Section 308 of the Constitution”. Any attempt to impeach a governor outside the bounds of due process violates this constitutional protection, further exposing lawmakers to legal and ethical consequences. Attempting to bypass immunity in the pursuit of partisan goals is not just unlawful; it undermines the rule of law itself.

Beyond legal concerns, partisan impeachment poses serious political risks. Political maneuvering aimed at personal or party advantage can destabilize government operations and strain relationships among lawmakers, political parties, and stakeholders in the state. Rivers State has a history of political tension, and pushing through an impeachment without clear, legitimate grounds could inflame divisions, creating an environment of mistrust and hostility.

Governance itself is a casualty in politically motivated crises. Lawmakers diverted by impeachment proceedings often neglect critical legislative responsibilities, leaving key policies unaddressed and public projects stalled. Investment decisions are affected, and the development trajectory of the state suffers. Citizens, who are the intended beneficiaries of democratic governance, ultimately bear the brunt of such instability.

Moreover, public perception matters. When impeachment is perceived as a partisan attack, trust in democratic institutions, the legislature, the judiciary, and the executive, erodes. Citizens may begin to question the integrity of their elected officials, leading to political apathy, disengagement, or civil unrest. A cycle of cynicism can take root, weakening the democratic fabric of Rivers State for years to come.

The consequences of reckless impeachment are not confined to politics or governance, they extend to the social and security environment. History has repeatedly shown that politically motivated crises can escalate into public protests, clashes between supporters of rival factions, and, in extreme cases, violent conflict. Such instability not only endangers lives but also undermines the broader sense of safety and communal harmony essential for a prosperous society.

Peaceful political discourse is the cornerstone of a functioning democracy. Lawmakers must remember that their actions send signals to citizens: whether political competition is conducted within constitutional and ethical boundaries, or whether it is reduced to a game of personal vendetta. By prioritizing legality, fairness, and decorum, Rivers State lawmakers can foster a political culture that respects dissent, values dialogue, and promotes peaceful conflict resolution.

At the heart of this caution is a simple truth: impeachment is not merely a contest between politicians; it is a mechanism that directly affects the will of the electorate. Governors are elected by the people to implement policies and drive development. Unjust or partisan removal undermines the mandate granted by the citizens, effectively nullifying their voice in governance. Disrespecting this principle corrodes the essence of representative democracy and sets a dangerous precedent for future political conflicts.

Lawmakers in Rivers State must recognize that democratic legitimacy depends on respecting constitutional limits and preserving the integrity of elections. Any action that bypasses these principles, no matter how politically expedient, risks long-term damage to the state’s democratic institutions and the public trust that sustains them.

Impeachment, when justified, is a legitimate tool for accountability. But when driven by political ambition, personal vendetta, or factional rivalry, it becomes destructive. Rivers State lawmakers must resist the temptation to exploit impeachment for short-term advantage and instead focus on creating a political environment that prioritizes governance, stability, and democratic norms.

Lawmakers must ensure that the impeachment process strictly adheres to constitutional procedures, with every step fully compliant with the law, while upholding due process through impartial, transparent, and fair investigations and hearings. Equally important is respecting the mandate given to Governor Fubara by the people of Rivers State, promoting peaceful political engagement that avoids actions likely to escalate tensions or provoke public unrest, and maintaining a focus on governance by prioritizing policy implementation, development projects, and the welfare of citizens over partisan disputes.

By upholding these principles, lawmakers can demonstrate that political power is exercised responsibly, with the welfare of the state and its citizens at the forefront.

The path to lasting political stability, good governance, and ideal democracy in Rivers State is clear: impeachment must never be used as a tool of expediency or retribution. It is a serious constitutional procedure designed to protect the state, not to settle political scores. Lawmakers are advised to weigh the consequences of reckless action carefully.

Failure to adhere to constitutional safeguards, respect due process, and honor the electorate’s mandate risks plunging Rivers State into political chaos, governance paralysis, and social instability. The judiciary, citizens, and history will not forgive political recklessness masquerading as accountability.
