Cameroon’s $616 Million Lesson in Sovereign Recklessness, by Fransiscus Nanga Roka

A government can have sovereign rights to the minerals under its soil but still make a hash of managing the legal obligations that surround their development. The Mbalam-Nabeba iron ore project straddles the border between Cameroon and the Republic of Congo An International Chamber of Commerce tribunal in January 2026 dismissed the claims by Sundance Resources and Congo Iron against Congo. The Paris-based company’s July announcement, reported by Reuters, said another ICC tribunal ordered Cameroon to pay Sundance and Cam Iron $616 million in damages, interest and costs.

Disregarding these awards as simply “contradictory” by conflating geography and law is not correct. Different contractual obligations, proof or state activity do not emerge from an individual mineral task. Why, the key topic, one government lost its case and its neighbour suffered huge liability.

Based on publicly available information, Gide argued that the tribunal found it reasonable to revoke the permit of Congo Iron because it failed to develop a project between 2016 and 2018. Sundance announced a challenge based on serious procedural irregularities.

Cameroon, for its part, sent a different kind of message. The tribunal ruled there was a violation of legal duties and non-compliance with an ICC emergency order from March 2022 banning the grant of the disputed Mbalam permit to third parties, Sundance added. Cameroons mines ministry did not reply to a request for comment from Reuters. Publicly reported results substantiate careful examination not imitative regurgitation of the narrative on either side.

Deepens a case of exorbitant governmental hubris: Vaunted high mindedness that could win costly international conflicts under a peaceful but inconvenient means of resolving disputes has simply been cast aside as garbage at will greenlit not by legitimate engagement with close engagement only obtainable through an emergency order. Replacing an investor might also well meet honest development goals. Neglect of applicable commitments may mean that policy choice becomes a claim on the public purse.

Firstly, Cameroon should conduct an independent review into the decisions that led to the award, publish its financial liability and details of how it intends to comply with or contest the 2016 decision. Shaming scapegoat should not trump accountability, which duly flies right into wrongdoing, and not a conveniently found official.

Second, neither jurisdiction should allow for disputed concessions to be reassigned without legal justification. Named compliance officers will also need to be provided for emergency orders along with ministerial notifications and documented procedures for modification requests.

Third, future mining agreements should have precise deadlines on payment of financing, delineation between infrastructure responsibilities and shared accountabilities related to development obligations; cure periods; termination procedures with clear burden of proof and transparency. The railway, port and mine also require the establishment of a co ordinated set of rules for cross border projects: fragmented obligations only invite fragmented disputes.

Fourthly, publish edited awards with valuation assumptions explained as far as is legally possible. Civic liabilities are too important to be sacrificed in the name of a corporation winning another city contest.

Finally, to the extent appropriate and observed quickly, Cameroon ought to likewise think about lawful settlement and approval choices. Sundance itself stated that the only way of collecting it might be through enforcement action. Award is not cash in hand nor a planner for precise fiscal planning.
