N60bn Fine: Court to Deliver Judgment in Facebook vs ARCON Case May 14

The court has fixed May 14, 2026, to rule on the dispute between Facebook Nigeria and ARCON over alleged advertising violations and a N60bn fine.

A Federal High Court in Lagos, presided over by Justice Yelim Bogoro, has fixed May 14, 2026, for judgment in the case between Facebook Nigeria Operations Limited and the Advertising Regulatory Council of Nigeria over a disputed N60 billion fine.

The case centres on ARCON’s claim that FNOL breached the Advertising Regulatory Council of Nigeria Act 2022 by running unapproved adverts targeting Nigerian users on Facebook and Instagram.

The regulator imposed the fine after alleging violations of Sections 34(3) and 54 of the Act, based on a notice issued in October 2024.

FNOL, however, insists it does not manage the platforms, pointing out that they are owned by Meta Platforms, Inc..

The company is asking the court to invalidate ARCON’s action and prevent future fines of a similar nature.

During proceedings, FNOL’s lead counsel, Mofesomo Tayo-Oyetibo, SAN, stressed the company’s right to fair hearing.

ARCON’s counsel, O. Kehinde, countered that the suit was flawed and argued that the matter should proceed to full trial.

Justice Bogoro adjourned the case until May 14, 2026, for judgment.
